Yields: Yields vary with the size and difficulty of arranging a line of credit. On transactions over $100 Million, transactions are frequently structured within bank administered trusts. Yields are kept very confidential and only revealed on a principal to principal basis by the bank officers directly. Timing: Generally packages are held until all required documents are presented and then submitted as a complete package. Once submitted, the documents are typically reviewed first by the Investment Manager (or his processing department) and by the credit line/trading bank.

Depending on the number of applications in process, the dollar amount requested, the nature of the asset, whether or not it can be bank confirmed, how complete the paperwork is, etc., the review process can take as little as 10 days, but usually it takes two or three weeks to complete. Investment contracts are not issued until the review process has been completed and the credit line has been established.

Applicants should realize that there are many more people trying to get into programs, than program slots available. They should also realize it costs time and money to review each package.
Consequently, Investment Managers usually take the best, most completely documented deals first since they are the easiest to complete. Therefore, be sure to provide to following information:

• Evidence that the asset is being made exclusively available. The Investment Managers will invariably reject any assets, which are shopped, since they all talk with each other regularly. We require a minimum 30-day exclusive.
• Evidence of clear title. As a minimum, the client needs to provide an Affidavit of Ownership going back to the current legal owner and may be required to provide a clear chain of title. If the asset has been assigned or leased, full documentation will also have to be provided for each step in the chain. Assets, which have been leased or assigned multiple times, are virtually impossible to work with, as are assets where a power of attorney has been assigned. These types of transactions can only be consummated on a principal direct basis, which means the bank to confirm the legal title will always contact the legal owner. All submitting brokers need to provide a cover letter presenting the asset, along with the names of others who are eligible to be paid, then step out of the way.
• Typically two "certified true" copies are required of all bank issued/historical instruments since color coding us frequently used to authenticate and verify the instrument and will speed up the review process. "Certified true" copies are issued by the bank which is holding the instrument. These are not color copies you get at the corner copy shop.
• With any asset, complete "un-sanitized" documentation needs to be presented as Proof of Funds (POF). All documentation presented needs to be very crisp, clear, clean and readable. No second, third, fourth, etc. generation faxes will be accepted as part of the formal package sent to the Trader. Any sanitized or de-faced documents will be immediately rejected.
• Full details on where the asset is located have to be provided. Almost always, a bank confirmation of the asset (e.g. bank safekeeping receipt) is required. Safekeeping that can be bank confirmed is preferred in all cases, and is a requirement of a majority of the programs. Similarly, if the asset is in a warehouse, copies of the warehouse receipts and insurance binder are required.
• After providing a full legal description of the asset, establishing legal title, and providing a bank safekeeping receipt (or other acceptable proof of the asset's existence), the next step is to determine its authenticity and current value. If applicable, current appraisals, reputable lab reports, and other verifiable third party evidence is required to establish the authenticity and market value of the asset. It is the responsibility of the asset owner to prove what they have and provide this information.
• Once al of the above has been presented and it has been determined that a line of credit can be arranged and accepted into a program, will specific terms and conditions, hypothecation amounts, profits, etc. available through that particular program be discussed, and then only by contract with the asset owner, or person with legal authority to commit the assets. No exceptions.

NOTE: In many cases we can find buyers for assets, which will accelerate the process considerably. When submitting your package, please indicate if the asset is for sale and under what terms and conditions.
